• A merchant, seller, buyer, retailer, broker, or auctioneer of any listed goods;
• A party to any contract, deal, sale, or agreement between buyers and sellers;
• A payment processor, escrow service, delivery service, or warehouse operator;
• An endorser, authenticator, or guarantor of any user, seller, buyer, or advertised item.

We do not hold inventory, possess, inspect, test, certify, pack, or deliver any goods. All terms of sale, price negotiations, inspections, handoffs, and payments are negotiated and executed directly between the buyer and seller.

2. Comprehensive Disclaimer of Warranties (“As-Is” & “As-Available”)

To the maximum extent permitted by applicable law, the whatsused.com website, its software, and all user-submitted content are provided strictly on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, statutory, or implied.

whatsused.com and related parties expressly disclaim all warranties, including but not limited to:

• Merchantability & Fitness: Any implied warranties of merchantability, fitness for a particular purpose, condition, durability, or quality;
• Title & Non-Infringement: Any warranty that items sold are free from liens, claims, encumbrances, or intellectual property infringements;
• Accuracy & Authenticity: Any warranty regarding the accuracy, completeness, authenticity, or truthfulness of descriptions, photographs, condition ratings, or claims made by users;
• User Trustworthiness & Safety: Any warranty regarding the character, identity, creditworthiness, legal capacity, or safety of any user;
• Service Availability: Any warranty of uninterrupted, secure, defect-free, or error-free website operation.

3. Limitation of Liability & Release

To the fullest extent allowed by law, in no event shall whatsused.com, its owners, operators, developers, hosting providers, or affiliates be liable for any direct, indirect, incidental, special, exemplary, consequential, or punitive damages arising out of or related to:

• Any transaction, attempted deal, or interaction initiated on or through whatsused.com;
• Defective, damaged, misrepresented, recalled, dangerous, or stolen goods;
• Financial losses, non-delivery, fraudulent payment methods, bounced checks, or unauthorized charges;
• Bodily injury, personal harm, assault, robbery, or property damage sustained during in-person meetings, inspections, or product handoffs;
• Loss of profits, loss of data, unauthorized server access, service interruptions, or software glitches.

Release: You hereby release and forever discharge whatsused.com and its operators from any and all claims, demands, disputes, and causes of action arising from disputes with other users.

4. User Eligibility, Minors & Parental Responsibility

By creating an account, posting listings, or communicating on whatsused.com, you certify and agree to the following:

• Age Requirement (18+): You are at least 18 years of age and legally competent to enter into binding agreements;
• Children Under 13 Strictly Prohibited (COPPA): whatsused.com is intended for general adult audiences and is not directed to children under 13. Anyone under 13 years of age is strictly prohibited from creating accounts, posting listings, or providing personal information. Upon receiving notice or acquiring actual knowledge that an account belongs to a child under 13, whatsused.com will promptly delete the account, all listings, and all personal data in compliance with the Children's Online Privacy Protection Act;
• Parental / Guardian Supervision & Financial Liability (Ages 13–17): Individuals between the ages of 13 and 17 may only use the platform under the active supervision of a parent or legal guardian. Any parent or guardian who permits a minor to use the service accepts these Terms of Service on behalf of the minor and assumes full legal, financial, and safety responsibility for all listings, communications, item handoffs, and in-person meetups;
• Item Ownership & Authority: You own the items you offer for sale and have full legal right to transfer title free and clear of liens;
• Truthful & Lawful Listings: Your listings are accurate, non-misleading, and strictly comply with all local, state, and federal laws;
• Indemnification & Defense: You (and your parent or guardian, if you are a minor) agree to indemnify, defend, and hold harmless whatsused.com, its owners, and operators against any claims, losses, liabilities, costs, damages, and legal fees resulting from your listings, breach of these terms, or violations of third-party rights.

5. Prohibited Items & Content

The following items and activities are strictly forbidden on whatsused.com:

• Firearms, firearm parts, ammunition, explosives, fireworks, and regulated weapons;
• Illegal narcotics, controlled substances, prescription drugs, and drug paraphernalia;
• Stolen property or items obtained through fraud or theft;
• Counterfeit, replica, bootleg, or trademark/copyright-infringing products;
• Recalled goods or hazardous materials (chemicals, radioactive items, biohazards);
• Adult services, explicit/pornographic materials, and human remains or organs;
• Financial instruments, lottery tickets, gift cards, cryptocurrency, or pyramid/escrow schemes.

whatsused.com reserves the right to remove any listing or suspend any account at any time at its sole discretion without prior notice.

6. Intellectual Property & DMCA Takedown Notice

whatsused.com respects copyright and trademark rights. If you believe your copyrighted work or registered trademark has been listed on this platform without authorization, please send a notice containing:

• Identification of the copyrighted work or trademark;
• The specific Item ID or URL of the allegedly infringing listing;
• Your contact info and a statement affirming good-faith belief that use is unauthorized.
